On Behalf of | Jun 6, 2023 | Criminal Law

In New Mexico, it is illegal to operate a vehicle while under the influence of alcohol or drugs. The state has stringent laws for this crime, especially if it happens a second or third time.

The rules and legal procedures for this crime do not favor defendants, and the law can be tough on people charged with these crimes, so it is critical to understand more about these crimes and their consequences.

Factors the court considers for sentencing

While the court looks at each case individually when deciding what the sentence will be and for how long, the person’s history, including their blood-alcohol level at the time of the DWI, their driving record and any prior convictions, can impact the severity of the punishment. If the DWI accident caused harm to another individual, for example, the court would take that into account as well.

Potential lifelong consequences

People convicted of a DWI crime can lose their job, impacting their relationships and many other consequences. Any of these infractions go on the person’s criminal record, which is public and available for people -including potential future employers- to see.

In addition, it can limit the areas in which the person wants to work. For example, some sentences will not allow the person to drive commercial vehicles. Also, people convicted of DWI crimes often face hefty fines and the suspension of their driver’s license, which can create a significant added problem in that person’s life.

Operating a vehicle while under the influence of drugs or alcohol is illegal in New Mexico, and the state has strict laws meant to deter citizens from committing these crimes.

If you are in that situation, however, it is critical to understand every step in the legal process and the potential consequences. If you are arrested for a suspected DWI, do not speak to the police and ask to speak with an attorney immediately.
