What If You Acted In Self-Defense?
If your weapons charge related to a situation where your life, property or family was in danger, New Mexico law considers deadly force legally justified when used in self-defense. A jury may find you acted in self-defense when there is strong evidence for the following:
- There was an appearance of immediate danger of death or great bodily harm to you as a result of an unlawful act or an act that would result in death/great bodily harm.
- You were put in fear of immediate death or great bodily harm.
- You used deadly force because of that fear.
- The apparent danger would have caused a reasonable person in the same circumstances to act as you did.
